You’d never guess it from the sound of the violins playing for Buy to Let but there were other significant changes to benefits and tax on housing this month.
As ‘investors’ rushed to beat the April 1 deadline for higher rates of stamp duty on second homes, the orchestra reached a crescendo after new affordability tests were proposed by the Bank of England.
All that noise meant much less was heard about their tenants facing up to the first year of an unprecedented four-year freeze in their local housing allowance and other benefits and tax credits.
After three years in which LHA increases were restricted to 1 per cent, housing benefit rates for private tenants will now stay the same until 2020. Whatever the problems faced by their landlords, that means tenants will inevitably see rising shortfalls between their benefit and their rent. Equally inevitably, you would think, evictions will rise.

Thanks to the persistence of a group of peers, we now know a little bit more about how the government wants higher Pay to Stay rents to work for tenants.
The details emerged on the sixth day of the committee stage of the Housing and Planning Bill on Monday (see Hansard here).
That followed confirmation in a government consultation response last week that there will be a taper and that tenants on housing benefit claimants will be exempt. As I blogged the next day, this was presented as a climbdown. The government says tenants on incomes just above the thresholds ‘will see their rent rise by only a few pounds each week’. This week’s Communities and Local Government questions featured rogue policies, rogue landlords and a rogue house builder.
Rogue policy number one is the Local Housing Allowance (LHA) cap and its impact on supported housing. As Labour MPs lined up to criticise it, housing minister Brandon Lewis pointed to the review expected in the spring and pledged:
‘The changes will come in in 2018, but we are very clear, and have always been very clear, that we will make sure that the most vulnerable in our society are protected.’
That was not good enough for Labour’s Roberta Blackman-Woods, who quoted estimates by Newcastle-based Changing Lives about the losses it and other providers will suffer and argued that the discretionary fund will be inadequate. Lewis responded by pointing to the £400m of funding for new specialist affordable homes in the Spending Review (not much use if housing benefit won’t cover the rent) and the £5.3bn Better Care Fund (which is about health and social care, not housing).
But it was not good enough for Tory MP Peter Aldous either, who called for urgent clarity on whether the cap applies to homeless hostels and foyers. ‘If it does not, there is a real worry that many will close and that, as a result, there will be an unnecessary rise in the numbers of young homeless people.’

There was a depressingly common theme at a conference in London on the future of housing organised by Shelter this week.
Speaker after speaker felt the need to apologise for what would be a litany of gloom and doom and attempted to find something, anything, to lighten the mood.
Toby Lloyd of Shelter started with the good news on the Housing and Planning Bill. There is some, believe it or not, in the small steps towards tackling bad private landlords. But even then there’s a worry that measures to help genuine landlords tackle abandonment could turn into a fast track for evictions for more unscrupulous ones.
Then it was time for the real gloom. From Starter Homes to Pay to Stay and fixed-term tenancies to forced council house sales, the bill looks set to accelerate the slow death of social housing. As Toby put it, up to now all forms of affordable housing provision have had two things in common: they remained affordable in perpetuity; and the subsidy was recycled into more housing. Housing Bill-style ‘affordable’ (Starter Homes and whatever Greg Clark says) does neither. What hope there is now rests on what improvements (if any) can be won in the House of Lords.

6) Wrong or right to buy
Nothing sums up how just much turned on the election result as what happened with the Right to Buy. In February I blogged about the clarification that meant even fewer homes sold under the existing policy were being replaced than previously thought. April brought a buccaneering Tory pledge to extend it to housing association tenants and fund it by forcing councils the sell their ‘expensive’ stock. It was hard to see how it could possibly stack up except as a political gimmick but that was pretty much the point. It was an eye-catching election promise by a party desperate for victory and it seemed designed as a manifesto commitment that could be traded away in coalition negotiations.
Except that it worked. The Tories were unexpectedly elected with an overall majority and the mash-up of think tank proposals written on the back of an envelope somehow had to be implemented. The results would be disastrous for local authorities and the government faced a long battle in the House of Lords. And then everything changed all over again as the most vociferous opponents of the policy decided to accept it voluntarily.

For some reason, George Osborne made me think back to the school playground as he set out his spending plans for the next five years.
As the sidekick and heir apparent to the head boy, the chancellor has the power to get what he wants. First he had to correct his mistake from the Summer Budget when he was caught redhanded trying to steal the dinner money of most of the poor kids. He has now handed it back to the Strivers but will be waiting for them in the bushes to claim it back after school.
With that out of the way, he was free to get the gang together to build some homes, by which he means almost exclusively homes to buy. First in line were his main allies the housebuilders.
When you’ve already benefited from billions of pounds worth of loans, guarantees and relaxations in the rules on planning and energy efficiency, what’s another £2.3bn between friends? Yet this was different: the first time that I can remember that grant (presumably it is grant) has gone to pay for something that will not be recycled into more homes.

Two separate reports over the weekend claimed that housing benefit is being targeted by George Osborne for £2bn worth of savings to fix his tax credits debacle.
Iain Duncan Smith famously responded to Osborne’s July Budget ‘triumph’ with a fist-pumping celebration. The triumph soon began to crumble it became clear that the Budget really amounted to a message to work hard, do the right thing – and get screwed. As that realisation dawned, the scene was set for a struggle between the two Cabinet ministers played out in media briefings over an apparent raid on universal credit to pay for mitigation.

Three rival visions for housing in England from three rival politicians who all think they know best.
Let’s assume some of this is the result of private disputes about budgets (especially between Osborne and IDS) playing out in public. The run-up to any spending review features media briefings designed to promote pet projects or scupper those of others. But this is still different: it’s not pet projects at stake here but potentially the entire future of housing. And the rival visions directly contradict each other.

The impact assessment of the Housing Bill reveals two devils buried in the detail of proposals for a compulsory Pay to Stay.
First, the principles. The assessment says ‘the Government believes that those on higher incomes should not be subsidised through social rents’. There are 350,000 social rented tenants with household incomes over £30,000 a year including 40,000 with incomes over £50,000. Higher rents for these High Income Social Tenants (HISTs) are justified by the fact that they ‘benefit from a subsidised rent that could be as much as £3,500 less, on average, compared to equivalent rents in the private sector’.
Needless to say, neither of these figures is sourced. The government has form when it comes to changing its estimates of high earners (not to mention statistics in general) but:
‘This intervention is designed to remove an unfair subsidy. Households with a sufficiently high income do not require this, as they are able to access market housing.’

Looking to gauge the effects of the latest benefit cuts on housing? The official impact assessments are at best a starting point.
Documents published for the second reading of the Welfare Reform and Work Bill on Monday evening (available here) do give the Department for Work and Pensions’ (DWP) view on what to expect, but there are several reasons why it is a severely blinkered one.
First, they only cover what is actually in the Bill and many of the main housing benefit changes in the Budget do not require primary legislation.
So there is an impact assessment of the five-year freeze on most working age benefits but it does not include the freeze of the local housing allowance. Similarly, we do not get the DWP view on ending automatic entitlement to housing benefit for 18 to 21-year-olds because that will be done by regulation rather than primary legislation.
